According to the Ontario Wages Act, creditors can take up to 20% of your salary in wage garnishment. You will only know this is happening once it started, therefore there is no way of knowing it will happen beforehand. But there is a way to stop this and get rid of your debts.

Wage Garnishment Process in Ontario

For a creditor to garnish your wages, they will need to file a “Statement of Claim” to be able to obtain a court judgement and a wage garnishment order.

Once the court judgement has been issued, you as creditor will have 21 days to respond to dispute the debt being claimed in the Statement of Claim.

If the court do not receive a response from you within this period, it will assume that you have agreed to the claim your creditor has filed.

CRA Wage Garnishment

For CRA (Canada Revenue Agency) the process is different, they will not need to file a Statement of Claim or obtain a court judgement to be able to garnish your wages.

CRA will directly issue a pay notice to an employer instead of letting the debtor know about it.

Once the employer receives the notice to pay, the debtor’s salary will be garnished by remitting all amounts indicated in the letter. The collection officer’s information will be provided in the letter in case your employer needs to verify the information.
